1. These Terms and Conditions for using the SMS services shall be applicable and valid for MobilTel?Create EAD (referred to hereunder as MobilTel?Create) and for every user (referred to hereunder as THE USER), who has personally registered in the Internet site (http://www.mtel.bg, for using Internet or SMS services (referred to hereunder as Services).
2. The present Terms and Conditions shall be considered accepted and agreed to by THE USER on his/her confirmation thereof and on filling-in the registration form. THE USER shall be obligated to use the Internet and SMS services in conjunction with the present Terms and Conditions, as well as with "Terms and Conditions for Using the Services, Connected with the Internet Access via the MobilTel?Create EAD Network".
3. Registration through this web site shall be free of charge.
4. Using the services via the Internet sites mentioned in #1. shall be free of charge for the Internet users. If a MobilTel?Create subscriber needs to send a SMS massage when using a certain service, this SMS is charged according to the respective MobilTel?Create prices.
5. MobilTel?Create shall in no way or instance be hold liable, where, in case of service or operation breakdown of other Internet operators or of the telecommunication connections operation in or outside the country, a registered user shall be partly or completely unable to make use of the capabilities of the Services offered.
6. MobilTel?Create shall be hereupon obligated to keep the privacy of its USERS, and shall in no way and by no means make public the created user names and passwords or other personal data, filled by THE USERS without their prior consent, unless this shall have been required under and follow directly by order of the applicable legislation.
7. MobilTel?Create shall be entitled to cancel unilaterally, without any prior notice, the access to the offered Services, in case THE USER, with his/her actions blemishes the good name of the company and/or its services, or violates the laws of the Republic of Bulgaria or the international conventions, or threatens the efficiency and operability of the programming and technical means, by way of which the services, including those of other operators, are offered to the general public.
8. In case of evidenced infringements of the preceding article of the present Terms and Conditions, or if requested by the competent authorities of the Republic of Bulgaria, MobilTel?Create shall have the right to provide to them all available information about the actions and the identity of THE USER.
9. MobilTel?Create shall in no way or instance be hold liable towards THE USER for:
9.1. Any loss or damage, including lost profit, suffered by THE USER as a result of the use and/or the inability to use the Services;
9.2. Inability of THE USER to use one or every the Services;
9.3. Claims from third party against THE USER at or on occasion of using the service;
9.4. Dissemination of messages via Internet or SMS with contents which is vulgar or offensive to religious beliefs, faith and political affiliation. In case of evidenced infringement on that matter, MobilTel?Create shall take every technological and legislative measure for identifying the offenders and shall duly inform the competent authorities.
10. MobilTel?Create reserves the right to periodically change the structure of the Internet sites, as well as to amend the Terms and Conditions for using the respective services, without any obligation to serve a prior notice to its users.
11. THE USER shall be obligated hereunder to inform the operator of the Internet sites about mistakes, technical and other problems, connected with the usage of the services, on the support hotline +359 (88) 1010 prior to the registration, or afterwards on the following Internet address "Contacts" .
12. Only a user, who has conformed to the Terms and Conditions, shall be eligible to use the Internet and SMS services offered through the Internet sites mentioned in #1.
13. For all matters not dealt with in these Terms and Conditions the currently effective legislation of the Republic of Bulgaria shall apply.
14. The parties hereto shall make every effort to settle amicably and by mutual consent all disputes that may arise in relation to the present Terms and Conditions. In case no settlement can be arranged in that way, either party shall be free to bring the disputed matter to the competent court of law.
